As it stands, in theory (as it's complete... well, completely unenforceable legally to put it politely) Klaus can't even mention the band or its current members by name on any website & in any context for the rest of his life... Bloody 'ell! I can't think of anything that Klaus could have done that would have been so bad to warrant that sort of hand. What did he do - threaten to remix one their songs with a Madonna track? |

Note i did say "in theory" - it is simply an example of how tied his hands were over this that, as there's no way that he could be prevented from doing so (it not being unlawful), could be referred to. it may well have been an unintentional aspect of the way things were defined & what was demanded - aka poor wording by the lawyers - but i couldn't tell you for sure either which way as it does actually state it. The other options for the site were literally all that was left though... |

Well, that's what years of flagrant copyright infringement will get you, I guess. So you're a Duran fan who has no bootlegs, hasn't burned mp3s of cds you own on more than one computer, and never video taped anything off of tv. Watching 90% of Youtube videos would be off limits too (makes the viewer an enabler). I'm impressed! As for Duran - I could be wrong, but I bet if their management would have reached out and said, "you know - we understand what you're doing and on one hand really appreciate it, but ultimately we'd like to control these recordings and need you to remove them from your site and agree to stop posting them in the future" - *maybe* that would've been the way to go. I'm waiting for a letter telling me they're gonna take me to court for repeating "RCM SUCKS!!!". <grin> |

quite a shame DD's lawyers had the site shut down. They did? What's your source? I've not seen anything to say it was DD's lawyers that requested the site be shut down. It looks to me as if Klaus pulled the plug on his own rather then take down whatever was annoying the lawyers, whomever those lawyers were working for. Pocketdemon wrote guess you were wrong! why do you have it in for Klaus? |
